Terms and Conditions

Last updated: October 13, 2026

These Terms set out the basis on which you use MKY Remote ("MKY Remote", "we", "us", "our") — a platform providing remote, browser-based control of physical mobile devices and the tooling around them ("the Service"). They take effect the instant you register, sign in, or otherwise use the Service, including where you open an agency workspace or extend access to assistants or sub-users. If you can't accept any part of them, please don't use the Service.

1. What the Service is

We supply and keep running physical phones that you operate from a distance: device access, connectivity, availability, permission controls, health and uptime monitoring, a control dashboard, and the surrounding integrations. In short, we are a technical hosting provider — much like renting a server, except the server happens to be a phone. We don't create or operate accounts on Instagram, TikTok, Facebook or anywhere else for you, we publish nothing on your behalf, we never touch your login details, and we take no part in managing, growing, or automating your campaigns. Whatever you do with the phones is yours alone.

1.1 What we can and can't guarantee about hardware

Unless we've committed to it in writing, we can't promise any particular phone model, iOS version, carrier, or configuration. The precise devices on hand change over time through repairs, swaps, and ordinary operations.

2. Who may use it

You must be at least 18, legally able to enter a contract, and — on business plans — acting on behalf of a duly registered company, and everything you tell us has to be accurate. Keeping your login safe is down to you, and you answer for everything done under your account, including by any assistant or sub-user you bring in.

2.1 Identity checks

At any time, and for legal, compliance, or fraud-prevention reasons, we may ask you to confirm your identity — ID, company paperwork, ownership details — and we may apply this only to certain accounts depending on risk, location, or how intensively the Service is used. Decline, and we may restrict, pause, or terminate your access, with no refund owed in that event.

3. What you're responsible for

You own everything that takes place through your account and your rented phones, and that includes staying on the right side of the law — the rules of any platform you engage with (Meta, Apple, Google, TikTok and others), data-protection law, advertising law, and consumer law alike. Your business model and the way you run it are down to you, not us.

3.1 We're not answerable for what you do

We bear no responsibility for anything illegal or rule-breaking that you — or anyone using your access — carry out through the phones, hosting, or remote sessions we make available. Renting you a device does not mean we take part in, endorse, oversee, or sanction your activity.

3.2 We don't supervise or advise

We're under no obligation to observe, review, warn about, or intervene in what you're doing, and nothing we provide amounts to legal, compliance, or business advice.

4. What you may not do with it

You must not use the Service to:

  • break the law or defy a court order;
  • carry out fraud, scams, phishing, social engineering, or impersonation;
  • infringe anyone's intellectual-property rights;
  • make use of stolen or forged identities, or of unlawfully obtained hardware;
  • distribute malware or anything built to cause harm;
  • collect or process personal data unlawfully;
  • harm other people, or expose us to legal or reputational damage.

Breach any of these and we may pause or close your access immediately.

5. Child safety — absolute zero tolerance

We have absolutely no tolerance for child sexual abuse material or any exploitation of minors. Producing, uploading, storing, sharing, viewing, or transmitting such material — or assisting anyone in targeting a child — is entirely prohibited. Where it occurs, we close the account at once and for good, report it to the authorities, and cooperate fully with any investigation.

6. We don't monitor your activity

As a technical provider, we don't sift through your content, messages, or day-to-day activity. We do, however, keep the right to investigate and act on a credible abuse report, or wherever the law requires it.

6.1 Working with the authorities

Where the law requires it, we may comply with valid requests from courts, regulators, or law enforcement — including disclosing information or suspending the Service — and doing so does not breach these Terms.

7. Pausing or closing your access

We may suspend or terminate your access, with no liability to you, if you breach these Terms, if the law compels us, if your activity exposes us to legal or reputational risk, if you abuse the infrastructure, or if you fail to pay.

8. Fees and payment

You pay for the Service on the plan or at the price we agree, settled in cryptocurrency. Sums already paid are non-refundable except where our Refund Policy permits. Should a payment be late or fail, we may suspend your access, and any applicable taxes are your responsibility.

9. Our intellectual property

The platform and everything underpinning it — code, systems, infrastructure, design, documentation, and the MKY Remote name — is ours. For as long as your subscription runs, you receive a limited, revocable, non-transferable licence to use it. You may not copy, alter, distribute, or reverse-engineer it to uncover how it's built.

10. Data

Each side is responsible for its own data practices. We handle the account, billing, and usage information required to operate the Service, as described in our Privacy Policy (which forms part of these Terms). For any personal data you process through the Service, ensuring you have a lawful basis, the proper notices, and any needed consents rests with you.

11. Keeping things confidential

Neither side will disclose the other's non-public business or technical information gained through the Service.

12. No warranties

The Service is provided strictly as-is and as-available. We make no promise that it will fit a given purpose, run uninterrupted or error-free, keep your activity lawful, or produce any business outcome. You use it at your own risk.

13. Cap on our liability

To the fullest extent the law permits, we are not liable for indirect, incidental, special, consequential, or punitive losses — including lost revenue, lost data, reputational harm, fines, or downtime. Our total liability for anything connected to the Service is limited to the amount you paid us over the preceding three (3) months.

14. You cover claims caused by you

If any claim, loss, or legal cost falls on us — or on our staff, contractors, or partners — as a result of how you used the Service, any law or platform rule you broke, or your content or activity, you will defend us and cover it.

15. We're separate businesses

Nothing in these Terms makes us partners, employer and employee, a joint venture, or one another's agent. You run your own business and bear your own responsibility for it.

16. Changes to these Terms

We may update these Terms from time to time. Continuing to use the Service after a change takes effect counts as your acceptance of it.
